General

The services ("Service" or "Services") provided by DATARAN.ONLINE (the "Site") are offered by DATARAN ONLINE SERVICES, collectively referred to in this document as "DATARAN.ONLINE." These Services are governed by the following Terms of Service Agreement ("Agreement") as well as specific individual provisions and guidelines relevant to each type of user and service (collectively, "Agreements"). By using this Site, you agree to all sections of these Agreements as well as the Privacy Policy.

Article 1: Application of this Agreement

This Agreement is a binding legal document that applies to all users of the Site and all Services offered by DATARAN.ONLINE. By registering as a Member and using the Site, users acknowledge and agree to abide by all terms in this Agreement. These terms cover various aspects of the Site and Services, and together with any individual provisions, they form a complete and unified Agreement.

Article 2: Terminology

  • "Member" or "Members": Individuals or groups who register for an account on the Site and agree to the Terms of Service and Privacy Policy.
  • "Organizer" or "Organizers": Individuals or groups who create, manage, and host events on the Site.
  • "Co-organizer" or "Co-organizers": Members given permissions by an Organizer to assist in managing an event.
  • "Attendee" or "Attendees": Members who use the Site to purchase or acquire tickets to attend events hosted by Organizers.
  • "Event" or "Events": Any event created and hosted on the Site, for which tickets are available.
  • "Ticket" or "Tickets": Digital passes issued through the Site, typically in the form of QR codes, allowing entry to Events.
  • "Paid Ticket": Tickets sold through the Site in exchange for a fee, allowing Attendees access to paid Events.
  • "Free Ticket": Tickets issued at no cost, providing access to free Events.
  • "Transaction": The action of acquiring tickets, either through direct purchase or redemption on the Site.

Article 3: Role of DATARAN.ONLINE

DATARAN.ONLINE provides a platform where Organizers can offer and sell tickets to Attendees. However, DATARAN.ONLINE does not hold liability for the transactions between Organizers and Attendees, as it is merely a facilitator. Payment obligations of the Attendee are fulfilled when DATARAN.ONLINE receives the payment on behalf of the Organizer. If disputes arise between Organizers and Attendees (e.g., refund requests due to event cancellation), the parties must resolve the dispute directly. DATARAN.ONLINE holds no responsibility for these disputes and will not mediate or intervene.

Article 4: Membership, Registration, and Member Obligations

Membership registration is open to individuals who are 18 years and older. Minors (ages 13-17) require parental consent to register. Registration must be completed by the individual applying; representatives may not register on behalf of another person. Members must use the Site only for lawful purposes and agree to provide accurate and current information.

Article 5: Entering Member Information

When registering, all Members must accurately complete all required fields in the registration form. Inaccurate or incomplete information may result in limited access or suspension from the Site.

Article 6: Managing Username and Password

Members are responsible for securing their username and password. DATARAN.ONLINE encourages users to change their passwords periodically and is not liable for unauthorized access due to weak or compromised passwords. Any actions taken using a registered username and password are deemed as performed by the Member associated with that account.

Article 7: Updating Information

Members are responsible for keeping their registered information current and accurate. DATARAN.ONLINE is not liable for any issues resulting from outdated information, and prior Transactions will proceed based on the last updated data.

Article 8: Canceling Membership

Members wishing to cancel their membership may do so at any time, except Organizers with active, uncompleted events. Upon successful completion of the cancellation process, the account and related privileges will be terminated.

Article 9: System Environment

Members are responsible for ensuring their device, software, and internet connectivity are sufficient to access the Site and Services. DATARAN.ONLINE is not liable for any issues arising from inadequate or incompatible technology.

Article 10: Liability Limitations of DATARAN.ONLINE

DATARAN.ONLINE disclaims liability for any system downtime, data loss, or unauthorized access issues, except when caused by intentional or gross negligence on its part. Additionally:

  • DATARAN.ONLINE does not guarantee emails or content from its Site are free from viruses or harmful software.
  • Advice or information provided by DATARAN.ONLINE does not carry any liability.
  • DATARAN.ONLINE is not responsible for the accuracy or integrity of content posted by Organizers or linked external sites.
  • In no case shall DATARAN.ONLINE be liable for any consequential damages resulting from the use or inability to use the Site.

Article 11: Prohibited Actions

Members are prohibited from engaging in the following actions on the Site:

  • Engaging in illegal activities or violating Malaysian laws.
  • Using the Site to infringe on the rights or well-being of other Members or third parties.
  • Posting harmful, harassing, or defamatory content.
  • Sharing or promoting adult content or illegal substances.
  • Misrepresenting event information or intentionally providing false data.
  • Unauthorized collection of personal data from other users.
  • Engaging in any form of harassment, hate speech, or discriminatory behavior.
  • Advertising unrelated products or services or soliciting external transactions outside the Site.
  • Accessing or attempting to access another Member's account without permission.

Article 12: Handling of Member Information

Member information will be managed in accordance with DATARAN.ONLINE's Privacy Policy. This information may be used for the following purposes:

  • To provide and improve Services
  • For internal research and analysis
  • To enhance Site functionality
  • To communicate important updates and notifications

Article 13: Suspension or Revocation of Membership

DATARAN.ONLINE reserves the right to suspend or permanently revoke accounts under the following circumstances:

  • Violation of any terms in this Agreement
  • Posing a security risk to the platform or other users
  • Engaging in fraudulent or illegal activities
  • Providing false or misleading information

DATARAN.ONLINE is not liable for any damages arising from suspension or termination.

Article 14: Service Modification or Termination

DATARAN.ONLINE reserves the right to modify, suspend, or discontinue Services, either partially or entirely, at its discretion and without liability.

Article 15: Subcontracting of Services

DATARAN.ONLINE may subcontract or delegate any of its Service responsibilities to third parties to ensure optimal operation and maintenance of the Site.

Article 16: Personal Information Handling

All personal data collected will be handled in accordance with the Site's Privacy Policy.

Article 17: Advertising

DATARAN.ONLINE may display third-party advertisements on the Site. It holds no responsibility for the content or outcome of any interactions with third-party ads.

Article 18: Modifications to this Agreement

DATARAN.ONLINE reserves the right to amend this Agreement. Members will be notified of changes via email or a notification on the Site at least one (1) month prior to their effective date. Continued use of the Site after this period constitutes acceptance of the revised Agreement.

Article 19: Representations and Warranties

DATARAN.ONLINE ensures the following:

  • No association with any organized crime groups
  • Prohibition of illegal or unethical activities on the Site
  • Right to take legal action against violations
  • Authority to terminate accounts involved in illegal activities

Article 20: Severability

If any provision of this Agreement is found to be invalid or unenforceable under Malaysian law, the remainder of the Agreement will still apply.

Article 21: Governing Law and Jurisdiction

This Agreement is governed by the laws of Malaysia. Any legal disputes arising from the Agreement will be settled in Malaysian courts.

Individual Terms of Service for Event Organizers/Co-organizers

Article 1: Use of Services

These Terms of Service for Organizers/Co-organizers are part of the overarching Agreement governing the use of DATARAN.ONLINE's services. By creating an event page and tickets on our platform, you acknowledge and agree to the Organizer and Attendee terms. DATARAN.ONLINE may update these Terms without prior Organizer consent, and continued use signifies acceptance of any changes. Organizers may designate up to two Co-organizers for events, who are granted permissions to assist in event management. However, Organizers assume all responsibility for the conduct and actions of Co-organizers. Any disputes arising between Organizers and Co-organizers are outside DATARAN.ONLINE's responsibility.

Article 2: Personal Information

Organizers/Co-organizers are obligated to handle attendee data responsibly and adhere to the Personal Data Protection Act (PDPA) 2010. Any personal information collected (e.g., names, contact details) is strictly for event management purposes, and Organizers must disclose data usage terms to attendees in advance. Use of data outside the scope of event management or sharing attendee data with unauthorized parties is prohibited. DATARAN.ONLINE disclaims liability for any unauthorized agreements or data transactions made outside the platform.

Article 3: Event Creation and Ticketing

Organizers are responsible for accurately representing events on the platform, including event details, ticket pricing, and adherence to Malaysian law. Any complaints or claims by attendees due to discrepancies or non-conformities must be addressed by the Organizer. DATARAN.ONLINE reserves the right to intervene in complaints and may charge associated costs to the Organizer for handling such complaints.

Article 4: Disclosure for Published Events

Event Organizers must provide clear and accurate information on the event page. All online ticket purchases are processed through DATARAN.ONLINE's secure payment system and are not considered a direct transaction between the Organizer and the Attendee, thus ensuring a reliable payment experience for ticket buyers.

Article 5: Customer Support

Organizers are required to respond promptly to inquiries from DATARAN.ONLINE, Attendees, or third parties concerning event details or registered information. Neglecting these responsibilities may lead DATARAN.ONLINE to respond on the Organizer's behalf, if deemed necessary, to maintain service integrity.

Article 6: Event Review and Prohibitions

DATARAN.ONLINE reserves the right to review event content and deny or remove events that violate the platform's guidelines or local laws. Prohibited events include those related to:

  • Illegal activities
  • Sexual content
  • Unauthorized commercial solicitations
  • Any content deemed inappropriate or offensive

Events may be removed without prior notice if they are found to be in violation.

Article 7: Event Cancellation

Organizers may cancel events by following DATARAN.ONLINE's specified procedures. When an event is canceled:

  • Attendees are notified automatically
  • Tickets are voided
  • DATARAN.ONLINE will process full refunds
  • The Organizer will bear any cancellation-related fees

Article 8: Technical Requirements

To manage attendee check-ins, Organizers must ensure:

  • Access to a reliable internet connection
  • Compatible devices (e.g., smartphones or computers)

DATARAN.ONLINE is not liable for issues related to inadequate internet or device capabilities that may impact event management.

Article 9: Payouts

Flexible payouts allow Organizers to:

  • Request partial payouts upon reaching a specific sales threshold
  • Receive a full payout within five (5) business days post-event

Organizers must provide accurate bank details, as DATARAN.ONLINE is not responsible for payout delays due to incorrect information. If an event or account is suspended, payouts may be withheld.

Article 10: Event Promotion

Organizers may utilize DATARAN.ONLINE's promotion services, such as:

  • Email campaigns
  • Platform feature placements

Promotion services are subject to specific fees, and effectiveness may vary. Organizers acknowledge that while promotion can increase exposure, results are not guaranteed.

Article 11: Prohibition of Donation-Based Ticketing

Donation-based ticketing is generally prohibited unless it provides specific event-related benefits (e.g., entry rights, exclusive content). All donations must comply with Malaysian law, and Organizers are responsible for legal adherence.

Article 12: Representations and Warranties

Organizers represent and warrant the following:

  • No ties to organized crime or illegal activities
  • Compliance with all applicable laws and regulations
  • Accurate representation of event details and terms
  • Proper authority to host and manage events

Violations may result in:

  • Account suspension
  • Event removal
  • Legal action by DATARAN.ONLINE

Article 13: Suspension of Service Use

DATARAN.ONLINE reserves the right to suspend or terminate service under these conditions:

  • Detection of any violations
  • Threats to consumer safety
  • Non-compliance with platform policies
  • Repeated customer complaints

Organizers acknowledge that such actions are within DATARAN.ONLINE's discretion and cannot claim damages.

Article 14: Rights to Event Content

By using the platform, Organizers grant DATARAN.ONLINE:

  • Non-exclusive, royalty-free license to use event content
  • Right to use event materials for promotional purposes
  • Permission to display event information across the platform
  • Authority to modify or remove content as needed

Organizers confirm they possess all necessary rights to share and sublicense this content.

Individual Terms of Service for Attendees

Article 1: Usage of Services

This Individual Terms of Service for Attendees ("ToS for Attendees") applies to the use of services provided by DATARAN.ONLINE for the purchase or order of event tickets. By purchasing or ordering a ticket through DATARAN.ONLINE, attendees confirm their agreement to all terms outlined here. Any updates to these terms will take effect immediately upon being posted on the Platform.

Article 2: Ticket Pricing

Event organizers are responsible for setting the number and prices of tickets. The Platform serves only as a facilitator and does not influence ticket pricing. All prices include applicable taxes, and attendees are encouraged to review ticket costs before purchase.

Article 3: Ticket Order and Transaction

To purchase tickets, users must agree to this ToS and the Platform's Privacy Policy. A transaction is considered complete when the Platform sends a confirmation email. Tickets are stored digitally and can be accessed through the attendee's account, email or on the Platform's app or website. The Platform is not liable for delayed ticket receipt or any damage caused by incorrect attendee information during the purchase process.

Article 4: Event Inquiries

For event-specific questions (e.g., event timing, venue policies), attendees are responsible for contacting event organizers directly. DATARAN.ONLINE does not manage event logistics and thus has no obligation to respond to event-related inquiries.

Article 5: Ticket Return and Cancellation

Generally, ticket purchases are final and non-refundable. However, refunds may be granted under the following conditions:

  • Organizer-Approved Cancellations: If the attendee requests a refund and the organizer agrees, the Platform will process the refund according to its policies.
  • Event Cancellation: If an event is canceled, attendees will receive a refund via the payment method originally used (e.g., FPX or bank transfer). Cancellation fees may apply if more than 50 days have passed since the ticket order.

The Platform is not responsible for cancellations or event modifications initiated by the organizer.

Article 6: Liabilities and Refunds upon Event Cancellation

DATARAN.ONLINE is not responsible for notifying attendees if an event is canceled by the organizer. However, in cases where the organizer cancels the event, the Platform will refund attendees the purchase amount. Refunds are conducted through each respective payment method and may take several business days to process. The Platform bears no further responsibility for any additional costs incurred by the attendee due to event cancellation.

Article 7: Prohibition on Reselling Tickets

Tickets purchased through DATARAN.ONLINE are for personal use only and may not be resold or transferred for commercial gain. Tickets found to have been resold or purchased through unauthorized channels may be nullified, with no eligibility for a refund or entry to the event. The Platform may suspend or terminate accounts found in violation of this policy.

Article 8: Distribution of Coupons for Attendees

DATARAN.ONLINE may distribute promotional coupons or offers ("Coupons") to attendees. Use of Coupons is at the discretion of attendees, and the Platform bears no liability for third-party offers or potential damages incurred by attendees using or redeeming these Coupons. Coupons are not transferable or redeemable for cash and must be used according to the specific terms provided.

Article 9: Subscription Service

The Platform's subscription services include:

  • Community support features
  • Event-related activities
  • Special access to certain events
  • Additional benefits as defined by organizers

Please note:

  • Services are fully managed by the organizer
  • Terms, fees, and refund policies are set by organizers
  • The Platform is not responsible for service quality
  • Contact organizers directly for subscription issues

Article 10: Data Protection and Privacy

Attendees agree to the following data protection terms:

  • Compliance with PDPA 2010 requirements
  • Collection of data for ticket sales and updates
  • Right to access and correct personal data
  • Protection of data privacy and security

Article 11: Limitation of Liability

Platform liability limitations include:

  • No guarantee of event quality or safety
  • No responsibility for cancellations or postponements
  • Liability limited to ticket purchase cost
  • Resolution of disputes under Malaysian law

Article 12: Governing Law and Jurisdiction

This Agreement and its interpretation are governed by Malaysian law. Any disputes arising under this ToS will be resolved in Malaysian courts with jurisdiction over DATARAN.ONLINE.
